As an indication of how fact-intensive and individualized such a process would be, Chubb has submitted evidence that it had to depose the Landaus' former insurer just to establish the actual terms of their former policies. In addition, the chief actuary for the Landaus' former insurer testified that determining whether their decision to purchase a policy from Chubb was economically beneficial would be, as a practical matter, difficult. Further, he testified that completing the calculations necessary to make this determination would require proprietary information.
