A former Utah senator is suing Conseco, claiming insurance fraud.
Former U-S Senator Jake Garn has filed a class-action lawsuit against Conseco's life insurance division.
The lawsuit alleges that Conseco Life forced clients to pay dramatically higher premiums on certain universal life policies or surrender them for cash value to bolster its parent company's troubled finances.

I. BACKGROUND A. This action arises from a change Conseco Life made in how it computed cost of insurance charges for certain universal life insurance policies marketed under the "Lifestyle" or "Lifetime" product name.
Prior to this change, Conseco Life computed these charges using an actuarial variable (called the R-Factor) that had the effect of reducing the cost of insurance charges based on the amount in the policyholder's accumulation account.
Effective October 1, 2003, for certain Lifestyle policies, and May 1, 2004, for certain Lifetime policies, Conseco Life eliminated the use of the R-Factor and this change increased cost of insurance charges for many policyholders.
IT IS HEREBY STIPULATED AND AGREED, by, between and among plaintiffs Murray Gomer and Edward Jacob Garn, and defendants Conseco Life Insurance Company ("Conseco Life"), and Conseco, Inc., through their duly-authorized counsel, that the matters raised by Plaintiffs individually and 0n behalf of the nationwide and California classes certified in the above~captioned action are settled, compromised, and dismissed on the merits, and with prejudice, on the terms and· conditions set forth in this Settlement Agreement and the Release set forth herein, subject to the approval of the Court.
